Pride Health Clinic will begin offering signed and dated medical cannabis declarations for eligible patients in accordance with Nebraska’s Medical Cannabis Patient Protection Act (Initiative 437).
We want to be very clear about what this means — and what it does not mean — for patients.
Under Initiative 437, a licensed health care practitioner may provide a written declaration stating that, in the provider’s professional judgment, the potential benefits of medical cannabis may outweigh the potential risks for a patient’s condition or symptoms.
This declaration must be:
Written
Signed and dated by a licensed Nebraska health care practitioner
Issued within a legitimate patient-provider relationship
Our clinic may provide this declaration after a medical evaluation if it is clinically appropriate.
Nebraska does not currently have a medical marijuana card program.
A signed and dated declaration:
Is NOT a state-issued card
Is NOT a prescription
Does NOT register you with a state program
Does NOT guarantee access to medical cannabis
At this time:
Nebraska does not yet have licensed dispensaries
The regulatory system for medical cannabis is still being developed
Retail medical cannabis sales are not currently operating in the state
Because of this, a declaration does not allow you to purchase cannabis in Nebraska at this time.
Patients should understand that the law protecting patients and the system for obtaining medical cannabis are developing at different timelines.
In November 2024, Nebraska voters approved Initiative 437: The Nebraska Medical Cannabis Patient Protection Act.
This law:
Allows qualified patients to possess and use medical cannabis with a provider’s written declaration
Provides legal protections under state law for patients and caregivers acting within the law
Allows licensed Nebraska health care practitioners to issue signed and dated declarations
A companion initiative created the Nebraska Medical Cannabis Commission, which is responsible for developing the regulatory framework for licensing and oversight of the medical cannabis program.
Those rules and licensing processes are still being implemented.
Our goal is to provide accurate medical information and responsible clinical care while complying with Nebraska law.
