Is this a medical marijuana card?
No. Nebraska does not currently issue medical marijuana cards. A signed and dated declaration is a written statement from a licensed health care provider, not a state-issued card.
Can I buy cannabis in Nebraska with this declaration?
No. Nebraska does not yet have licensed dispensaries or retail sales for medical cannabis. A declaration does not allow you to purchase cannabis in Nebraska at this time.
Is this a prescription for cannabis?
No. Cannabis cannot be prescribed under federal law. The declaration simply documents that, in the provider’s medical judgment, the potential benefits may outweigh the risks for your condition.
Who can receive a declaration?
A declaration may be issued after a medical evaluation with a licensed Nebraska health care practitioner if it is clinically appropriate for the patient’s symptoms or condition.
How long is the declaration valid?
Declarations are generally valid for up to two years, unless the provider determines a shorter timeframe is appropriate.
What does Initiative 437 do?
Initiative 437, approved by Nebraska voters in 2024, allows patients to possess and use medical cannabis with a provider’s written declaration and provides certain protections under Nebraska state law. A separate regulatory system for dispensaries and licensing is still being developed.
Why offer declarations if cannabis cannot currently be purchased in Nebraska?
The law allowing provider declarations is already in effect, while the regulatory system for licensed dispensaries is still being created. These two parts of the program are being implemented on different timelines.
Do I have to receive a declaration to discuss cannabis with a provider?
No. Patients may discuss cannabis as part of their health care at any time. A declaration will only be issued if a provider determines it is medically appropriate.
